This website and online store are operated by Remarkable outdoor ApS.

Throughout these Terms of Service (“Terms”), the words “we,” “us,” “our” and the “Company” refer to Remarkable outdoor ApS.

We provide access to our website, online store, product information, content, functions, tools, checkout services and related customer services. These are collectively referred to as the “Services.”

Our online store uses Shopify's e-commerce platform to provide the technical infrastructure through which the Services are made available.

These Terms govern your access to and use of the Services, including purchases made through our online store.

Our Privacy Policy, Return and Refund Policy, Shipping and Delivery Policy, Payment Policy and other policies displayed through the Services may also apply to your use of the Services and purchases.

Please read these Terms carefully before using the Services.

By visiting the website, creating an account, placing an order or otherwise using the Services, you agree to comply with these Terms.

Nothing in these Terms is intended to exclude, restrict or reduce any mandatory consumer right that cannot legally be waived.

3. Eligibility and Use of the Services

Where a person has not reached the applicable age of legal capacity, the Services should only be used with the involvement and authorization of a parent or legal guardian where permitted by law.

  • Is using the Services for fraudulent or unlawful purposes;

Any such action remains subject to applicable law and mandatory consumer rights.

Please contact us promptly if you believe your account has been accessed or used without authorization.

You must not use another person's account without permission.

We make reasonable efforts to ensure that product descriptions, specifications, prices, photographs and other information displayed through the Services are accurate.

However, the appearance of a product may differ slightly from what appears on your screen because of factors including:

  • Screen settings;

  • Device displays;

  • Lighting;

  • Photography;

  • Manufacturing variations; or

  • Reasonable product updates.

Product photographs are generally provided to illustrate the relevant product.

We may update product descriptions, specifications or other information where reasonably necessary to correct inaccuracies or reflect changes to a product.

Nothing in this section affects any mandatory rights you may have where a product is defective, incorrectly described or does not conform to the purchase contract.

6. Product Availability

All products are subject to availability.

Adding a product to your shopping cart does not necessarily reserve the product or guarantee that it will remain available.

If a product becomes unavailable after an order is submitted, we may, as appropriate:

  • Cancel the affected product;

  • Contact you for further instructions;

  • Offer an appropriate alternative where you agree to it; or

  • Refund any amount already paid for the unavailable product.

We will not substitute a materially different product without your consent.

7. Placing an Order

Submitting an order through the Services constitutes an offer to purchase the selected products.

An automated order acknowledgement generally confirms that we have received your order. It does not necessarily mean that your order has been accepted.

A purchase contract will normally be formed when we:

  • Confirm acceptance of your order;

  • Confirm that the order has been dispatched; or

  • Otherwise expressly confirm acceptance.

Please review your order carefully before submitting it.

  • Products selected;

  • Quantities;

  • Product variations;

  • Billing information;

  • Delivery information; and

  • Contact information.

If you discover an error, please contact us as soon as possible.

Once an order has entered processing or fulfilment, we may not always be able to modify or voluntarily cancel it.

This does not affect any statutory cancellation or withdrawal rights available to you.

8. Order Acceptance, Rejection and Cancellation

We may reject or cancel an order where reasonably necessary, including where:

  • A product is unavailable;

  • Payment cannot be authorized or verified;

  • Billing or delivery information appears materially incorrect;

  • Fraudulent or unauthorized activity is reasonably suspected;

  • An obvious pricing or product-information error has occurred;

  • Applicable purchase limits have been exceeded;

  • Delivery to the supplied destination is unavailable; or

  • Processing the transaction would violate applicable law.

If an order is cancelled after payment has already been collected, the relevant amount will be refunded using the original payment method or another appropriate method where agreed or legally required.

Nothing in this section limits your mandatory consumer rights.

9. Personal and Lawful Purchases

Unless otherwise agreed, products purchased through our consumer online store are intended for lawful personal or household use.

You must not use the Services for:

  • Fraudulent transactions;

  • Unlawful resale;

  • Unlawful export;

  • Sanctions evasion;

  • Misrepresentation;

  • Money laundering;

  • Unauthorized payment activity; or

  • Any other unlawful purpose.

We may restrict quantities or reject transactions where there are reasonable grounds to suspect fraudulent or unlawful activity.

10. Prices and Promotions

The price payable for a product will normally be the price displayed when you submit your order, subject to correction of obvious errors and applicable law.

Prices, promotional offers and discounts may change from time to time.

Changes to prices will not normally affect orders that have already been accepted.

Promotions may be subject to separate conditions such as:

  • Eligibility requirements;

  • Promotional periods;

  • Product restrictions;

  • Minimum purchase requirements;

  • Maximum discounts; or

  • Usage limits.

Where a specific promotion has separate conditions, those conditions will apply to that promotion.

11. Taxes, Customs and Additional Charges

Applicable taxes, delivery charges and other costs will be displayed during checkout where required and reasonably possible.

Orders delivered across national borders may potentially be subject to:

  • VAT;

  • Customs duties;

  • Import charges;

  • Customs-clearance fees; or

  • Other charges imposed by authorities in the destination country.

Where such charges are included in the price paid to us, this will normally be indicated during checkout.

Where charges are imposed independently by authorities or third parties and are not included in the order price, responsibility for those charges will be determined according to the information provided at checkout and applicable law.

12. Payment

You agree to provide accurate and complete payment and billing information.

By using a payment method, you confirm that you are authorized to use that method.

Available payment methods will be displayed during checkout.

Payment methods may vary depending on factors including:

  • Destination country;

  • Currency;

  • Order value;

  • Product;

  • Delivery method; and

  • Payment-provider availability.

Payments may be processed through Shopify or independent payment service providers.

Those providers may apply their own terms, privacy policies, fraud-prevention procedures and security requirements.

We may delay or cancel an order where payment cannot reasonably be verified or authorized.

Where an order is cancelled after payment has been collected, an appropriate refund will be issued.

13. Shipping and Delivery

Shipping and delivery are governed by our Shipping and Delivery Policy.

Delivery periods displayed through the Services are estimates unless expressly stated to be guaranteed.

Delivery may occasionally be affected by circumstances including:

  • Carrier delays;

  • Customs procedures;

  • Incorrect delivery information;

  • Severe weather;

  • Public holidays;

  • Transportation interruptions;

  • Regulatory restrictions;

  • Strikes;

  • Natural disasters; or

  • Other circumstances outside our reasonable control.

You are responsible for providing an accurate and complete delivery address.

Please contact us as soon as possible if you discover an error in the address supplied for an order.

If a failed delivery is caused by materially incorrect or incomplete delivery information provided by the customer, reasonable additional delivery expenses may be charged where permitted by law.

For consumer purchases, risk of loss or damage will pass in accordance with applicable consumer law.

14. Returns and 14-Day Right of Withdrawal

Returns, exchanges and refunds are governed by our Return and Refund Policy.

Consumers who enter into an eligible distance-selling contract may have a statutory right to withdraw from the purchase within 14 days, subject to applicable exceptions.

Where the statutory withdrawal right applies, the consumer may generally withdraw without providing a reason.

The consumer must notify us of the decision to withdraw before the applicable withdrawal period expires.

After providing the withdrawal notice, the goods must be returned within the applicable statutory period.

Where properly disclosed and permitted by law, the consumer is responsible for the direct cost of returning goods following a change-of-mind statutory withdrawal.

Different rules apply where a product is defective, damaged, incorrect or otherwise non-conforming.

Our voluntary 30-day return policy provides additional return opportunities and does not replace or reduce statutory consumer rights.

15. Defective Products and Statutory Consumer Rights

Nothing in these Terms limits rights available to consumers regarding goods that:

  • Are defective;

  • Do not conform to the purchase contract;

  • Are materially different from their description;

  • Do not possess characteristics that consumers are legally entitled to expect; or

  • Otherwise fail to satisfy mandatory consumer-protection requirements.

For consumer purchases subject to Danish consumer law, statutory rights concerning defects may apply for up to two years, subject to the conditions and requirements of applicable law.

Any voluntary commercial guarantee or manufacturer's warranty is additional to, and does not replace, mandatory statutory consumer rights.

If you believe that a product is defective or non-conforming, please contact us promptly with your order information and a description of the problem.

16. Refunds

Refunds are processed in accordance with our Return and Refund Policy and applicable law.

Approved refunds will normally be returned using the original payment method unless:

  • Another method is agreed;

  • The original payment method cannot reasonably receive the refund; or

  • Applicable law requires another method.

Refund timing may depend on:

  • The reason for the return;

  • The payment method;

  • When the returned goods are received;

  • When valid evidence of return is provided; and

  • Processing times of payment providers.

Where a statutory withdrawal right applies, refunds will be handled within the applicable statutory period.

Where permitted by law, reimbursement may be withheld until we receive the returned goods or sufficient evidence that they have been sent back.

17. Intellectual Property

Content made available through the Services may be protected by copyright, trademark and other intellectual-property laws.

Protected content may include:

  • Business names;

  • Brand names;

  • Logos;

  • Product names;

  • Product descriptions;

  • Photographs;

  • Graphics;

  • Videos;

  • Text;

  • Designs;

  • Website layouts;

  • Software;

  • Icons; and

  • Other original content.

Such content may belong to Remarkable outdoor ApS, Shopify, our licensors, suppliers or other rights holders.

Unless otherwise permitted by law or expressly authorized, you must not:

  • Copy protected content;

  • Reproduce it for commercial purposes;

  • Modify or adapt it;

  • Republish or redistribute it;

  • Create unauthorized derivative works;

  • Sell or commercially exploit it;

  • Remove intellectual-property notices; or

  • Use trademarks or brand materials without permission.

Nothing in these Terms transfers ownership of intellectual property to you.

18. Customer Reviews and Submitted Content

Where the Services allow you to submit reviews, comments, photographs, videos, suggestions or other content, you remain responsible for that content.

You confirm that content submitted by you:

  • Is accurate to the best of your knowledge;

  • Is owned by you or submitted with appropriate permission;

  • Does not infringe another person's intellectual-property, privacy or other rights;

  • Is not unlawful;

  • Is not deliberately misleading;

  • Is not abusive, defamatory or threatening; and

  • Does not contain viruses or malicious software.

Where you submit content for publication through our Services, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, translate, publish and display that content for legitimate purposes connected with operating and promoting the Services.

You retain ownership of your original content.

We may refuse or remove submitted content where reasonably necessary because it violates these Terms, applicable law or another person's rights.

19. Third-Party Tools and Services

The Services may include tools, payment services, applications, integrations or features supplied by independent third parties.

We may not own or control those services.

Your use of an independent third-party service may be subject to that provider's own:

  • Terms of service;

  • Privacy policy;

  • Payment conditions;

  • Security requirements; and

  • Other policies.

You should review applicable third-party conditions before using the relevant service.

20. Third-Party Links

The Services may contain links to independent third-party websites, applications or platforms.

We do not necessarily control or operate those services.

The inclusion of a third-party link does not automatically mean that we endorse or control that third party.

Transactions entered into directly with an independent third party will normally be governed by the agreement between you and that third party.

21. Shopify

Our online store uses Shopify's e-commerce infrastructure.

Shopify provides technology used to host or operate aspects of the online store, shopping cart and checkout.

Products purchased from our store are sold by Remarkable outdoor ApS, unless expressly stated otherwise.

Shopify is not the seller of products sold by Remarkable outdoor ApS and is not a party to the purchase contract between you and Remarkable outdoor ApS.

Shopify may independently process certain information in accordance with its own privacy documentation and applicable law.

22. Privacy

Personal information collected in connection with the Services is processed in accordance with our Privacy Policy.

Our Privacy Policy explains matters including:

  • Categories of information collected;

  • Purposes for which information is used;

  • Legal bases for processing where applicable;

  • Service providers with whom information may be shared;

  • Cookies and tracking technologies;

  • Data retention;

  • International transfers; and

  • Privacy rights available to customers.

Because our online store uses Shopify and other service providers, those providers may also process information necessary to provide their respective services.

23. Errors and Corrections

Information displayed through the Services may occasionally contain:

  • Typographical errors;

  • Incorrect pricing;

  • Outdated product information;

  • Incorrect delivery estimates;

  • Availability errors; or

  • Other inaccuracies.

We may correct inaccurate information when an error is identified.

Where an obvious error materially affects an order, we may contact you and, depending on the circumstances, offer to:

  • Proceed using corrected information with your agreement;

  • Provide an appropriate alternative; or

  • Cancel the affected order and issue an appropriate refund.

Nothing in this section limits mandatory consumer rights.

  • In violation of applicable law;

  • To infringe intellectual-property or privacy rights;

  • To harass, threaten or abuse another person;

  • To submit materially false information;

  • To impersonate another person or business;

  • To transmit viruses or malicious software;

  • To obtain unauthorized access to an account or system;

  • To interfere with website security;

  • To interfere with the operation of the Services;

  • To unlawfully collect personal information;

  • To bypass security controls; or

  • To commercially exploit protected content without authorization.

We may take reasonable measures to protect the Services against unlawful or harmful activity.

Automated software, robots, scraping tools, artificial-intelligence agents or similar systems must not access or interact with the Services in a manner that:

  • Creates an unreasonable operational burden;

  • Interferes with website performance;

  • Violates intellectual-property rights; or

  • Otherwise violates these Terms or applicable law.

We may use reasonable technical measures to restrict automated activity that creates security, privacy, operational or legal risks.

26. Suspension and Termination

We may suspend or restrict access to some or all of the Services where reasonably necessary because:

  • These Terms have been materially breached;

  • Fraud or unlawful activity is reasonably suspected;

  • Website or account security has been threatened;

  • The Services are being misused; or

  • We are required to do so by law.

Where reasonably possible and legally appropriate, notice may be provided.

Suspension or termination does not affect rights and obligations that arose before the relevant action.

27. Availability of the Services

We make reasonable efforts to keep the Services available, functional and secure.

However, the Services may occasionally be unavailable because of:

  • Maintenance;

  • Technical problems;

  • Software updates;

  • Hosting issues;

  • Security incidents;

  • Network outages; or

  • Other operational circumstances.

We do not guarantee that the website will always operate without interruption or temporary technical errors.

Nothing in this section affects obligations or rights that cannot legally be excluded.

28. Limitation of Liability

To the maximum extent permitted by applicable law, Remarkable outdoor ApS will not be liable for indirect, incidental or consequential losses that were not reasonably foreseeable when the relevant contract was formed.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

In particular, these Terms do not exclude or restrict liability for matters such as:

  • Fraud or fraudulent misrepresentation;

  • Intentional misconduct;

  • Death or personal injury caused by negligence where liability cannot lawfully be excluded;

  • Mandatory product liability;

  • Violation of non-waivable consumer rights; or

  • Any other liability that cannot legally be excluded or restricted.

Your mandatory consumer remedies remain unaffected.

29. Customer Responsibility

To the extent permitted by law, you may be responsible for reasonable loss directly caused by:

  • Your unlawful use of the Services;

  • Your material breach of these Terms;

  • Your infringement of another person's rights; or

  • Content submitted by you without the necessary rights or authorization.

You will not be responsible for loss caused by our own breach, negligence or unlawful conduct.

30. Events Outside Our Reasonable Control

We will not be responsible for a failure or delay caused solely by circumstances outside our reasonable control, except where applicable mandatory law provides otherwise.

Such circumstances may include:

  • Natural disasters;

  • Extreme weather;

  • War or civil unrest;

  • Government action;

  • Epidemics;

  • Strikes;

  • Transportation disruption;

  • Telecommunications failures;

  • Power outages;

  • Customs restrictions; or

  • Major failures of third-party infrastructure.

Where such an event affects an order, we will take reasonable steps to reduce its impact where possible.

Mandatory consumer rights remain unaffected.

31. Severability

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will apply to the fullest extent legally permitted.

The remaining provisions will continue in effect.

32. No Waiver

If we delay or fail to enforce a right under these Terms, this does not automatically mean that we have waived that right.

A waiver concerning one matter does not automatically constitute a waiver concerning another matter.

33. Entire Agreement

These Terms, together with the policies and information incorporated by reference, govern your use of the Services.

Nothing in this section excludes information, representations or rights that legally form part of a consumer purchase agreement.

34. Assignment

You may not transfer your customer account or contractual obligations to another person without our prior approval, except where applicable law permits otherwise.

We may transfer our rights and obligations as part of a legitimate:

  • Business sale;

  • Merger;

  • Restructuring; or

  • Transfer of business assets.

Any such transfer will not reduce mandatory consumer rights.

35. Governing Law and Disputes

These Terms and purchases made from Remarkable outdoor ApS are governed by the laws of Denmark, subject to applicable conflict-of-law and mandatory consumer-protection rules.

If you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protections that apply to you under applicable law.

If a dispute arises, we encourage you to contact us first so that we can attempt to resolve the matter directly.

Where a dispute cannot be resolved directly, the customer may have the right to submit the dispute to an appropriate consumer dispute-resolution body or competent court.

Nothing in these Terms requires a consumer to waive a right to bring a claim before a court that has jurisdiction under applicable consumer law.

36. Changes to These Terms

We may update these Terms from time to time to reflect:

  • Changes to the Services;

  • Changes in our business operations;

  • Changes in technology;

  • Legal or regulatory requirements;

  • Security developments; or

  • Other legitimate operational requirements.

The current version will be published through the Services together with the applicable revision date.

Where legally required, appropriate notice will be provided before a material change takes effect.

Changes to these Terms will not retroactively remove mandatory rights connected with a purchase that has already been completed.

38. Mandatory Consumer Rights

Nothing in these Terms is intended to exclude, restrict or reduce any mandatory rights or remedies available to consumers under applicable consumer-protection law.

Where a provision of these Terms conflicts with a mandatory legal requirement that applies to a consumer, the mandatory legal requirement will prevail.
