3. Use of the Services

You may use our services only for lawful purposes and in accordance with these Terms.

Where applicable, users must be legally capable of entering into the relevant purchase agreement.

We may reasonably restrict access where necessary to prevent fraud, unlawful activity, security risks or material violations of these Terms, subject to applicable law.

4. Customer Information and Accounts

Where customer accounts or similar features are available, you are responsible for providing accurate and current information.

You are also responsible for maintaining the confidentiality of your account credentials.

Please contact us if you believe that your account has been accessed without authorization.

5. Product Information

We make reasonable efforts to provide accurate product descriptions, specifications, prices, photographs and other product information.

Product appearance may differ slightly from images displayed online because of factors such as screen settings, lighting, photography or reasonable manufacturing variations.

Product information may be updated where reasonably necessary to correct inaccuracies or reflect product changes.

Nothing in this section affects mandatory rights relating to defective, incorrectly described or non-conforming products.

6. Product Availability

Products are subject to availability.

Adding a product to your shopping cart does not necessarily reserve the product.

If a product becomes unavailable after an order is submitted, we may contact you, cancel the affected item or order, or provide another appropriate solution in accordance with applicable law.

A materially different substitute will not be supplied without your agreement.

Where payment has already been collected for an item that cannot be supplied, an appropriate refund will be provided.

7. Orders

Please review your order carefully before submitting it.

You are responsible for checking information such as:

  • Products;

  • Quantities;

  • Product variations;

  • Contact information;

  • Billing information; and

  • Delivery information.

Submitting an order does not necessarily mean that the order has been finally accepted.

An automated order acknowledgement may confirm receipt of an order without constituting final acceptance.

Where reasonably necessary and permitted by law, an order may be rejected or cancelled because of circumstances such as:

  • Product unavailability;

  • Payment authorization failure;

  • Materially incorrect order information;

  • Suspected unauthorized or fraudulent activity;

  • An obvious pricing or product-information error;

  • Unavailable delivery to the supplied destination; or

  • Legal or regulatory requirements.

If an order is cancelled after payment has been collected, an appropriate refund will be provided.

8. Prices and Promotions

Product prices are displayed through our online store.

The final amount payable will normally be shown during checkout before the order is submitted.

Prices and promotional offers may change from time to time.

Promotions may be subject to additional eligibility requirements, dates, product restrictions or other conditions displayed with the relevant promotion.

Nothing in this section affects mandatory rights relating to an order already accepted.

9. Taxes and Additional Charges

Applicable taxes, delivery charges and other amounts payable to us will be displayed during checkout where applicable.

Cross-border orders may be subject to VAT, customs duties, import taxes or other charges depending on the destination and applicable law.

Where such charges are included in the amount collected by us, this will be reflected where appropriate.

Charges imposed independently by authorities or third parties may be outside our direct control.

10. Payment

Available payment methods are displayed during checkout.

Payment-method availability may vary depending on factors such as:

  • Destination;

  • Currency;

  • Product;

  • Order value;

  • Delivery method; and

  • Payment-provider availability.

Payments may be processed by Shopify or independent payment providers.

Third-party payment providers may apply their own terms, privacy policies and security procedures.

An order may be delayed or cancelled where payment cannot reasonably be authorized or verified.

Please review our Payment Policy for additional information.

11. Shipping and Delivery

Shipping and delivery are governed by our Shipping and Delivery Policy.

Delivery periods displayed through our online store are estimates unless expressly stated otherwise.

Actual delivery times may vary because of carrier operations, customs procedures, public holidays, local delivery conditions or circumstances outside our reasonable control.

Customers are responsible for providing accurate and complete delivery information.

Nothing in this section limits mandatory consumer rights relating to delivery.

12. Returns and Withdrawal Rights

Returns and refunds are governed by our Return and Refund Policy.

Eligible consumers in the European Union or European Economic Area generally have a statutory 14-day right of withdrawal for eligible distance purchases, subject to applicable legal requirements and exceptions.

Our voluntary 30-day return policy provides additional return opportunities for eligible products and does not replace or reduce statutory consumer rights.

Please review our Return and Refund Policy for complete conditions and return instructions.

13. Defective or Non-Conforming Products

Mandatory consumer rights concerning defective, damaged, incorrectly described or otherwise non-conforming goods remain unaffected.

Where a product does not conform to the purchase contract, available remedies will be determined according to applicable consumer law and the circumstances of the case.

Depending on applicable law and circumstances, remedies may include:

  • Repair;

  • Replacement;

  • Price reduction;

  • Return; or

  • Refund.

Any voluntary manufacturer's warranty or commercial guarantee, where applicable, is additional to mandatory statutory consumer rights.

14. Refunds

Refunds are handled in accordance with our Return and Refund Policy and applicable law.

Approved refunds will normally be returned using the original payment method unless another method is agreed, the original method cannot reasonably receive the refund or applicable law requires another method.

Refund processing and the time required for funds to appear may depend on the payment provider and circumstances of the refund.

15. Intellectual Property

Content made available through our services may be protected by copyright, trademark or other intellectual-property rights.

Such content may belong to Remarkable outdoor ApS, Shopify, licensors, suppliers, manufacturers or other rights holders.

Nothing in these Terms transfers ownership of third-party intellectual property to Remarkable outdoor ApS or to the customer.

Protected content must not be unlawfully copied, reproduced, redistributed or commercially exploited.

16. Customer-Submitted Content

Where our services allow customers to submit reviews, comments, photographs or other content, customers remain responsible for the content they submit.

Submitted content must not:

  • Violate applicable law;

  • Infringe third-party rights;

  • Be deliberately misleading;

  • Contain malicious software; or

  • Otherwise misuse our services.

Where content is submitted for publication, we may use it for legitimate purposes connected with operating the relevant service, subject to applicable law.

17. Third-Party Services

Our online store may use or link to services provided by independent third parties.

These may include payment providers, delivery providers, applications or other technical services.

We do not necessarily control independent third-party services.

Use of those services may be subject to the relevant provider's own terms and privacy policies.

18. Shopify

Our online store uses Shopify's e-commerce infrastructure.

Shopify provides technology used to operate aspects of the online store, shopping cart and checkout.

Products purchased directly from our store are sold by Remarkable outdoor ApS, unless expressly stated otherwise.

Shopify and other service providers may process certain information according to their own applicable terms and privacy documentation.

19. Privacy

Personal information is processed in accordance with our Privacy Policy.

Please review the Privacy Policy for information concerning personal information, cookies, service providers and applicable privacy rights.

20. Errors and Corrections

Information displayed through our services may occasionally contain errors or outdated information.

Where an error is identified, we may correct it.

If an obvious error materially affects an order, we may contact you and provide an appropriate solution in accordance with applicable law.

Nothing in this section limits mandatory consumer rights.

21. Prohibited Conduct

You must not use our services:

  • For unlawful or fraudulent purposes;

  • To infringe intellectual-property or privacy rights;

  • To provide materially false information;

  • To impersonate another person or business;

  • To interfere with website security;

  • To distribute malicious software;

  • To obtain unauthorized access to accounts or systems; or

  • In another manner prohibited by applicable law.

We may take reasonable measures to protect our services against unlawful or harmful activity.

22. Availability of the Services

We make reasonable efforts to keep our online services available and functional.

However, temporary interruptions may occur because of maintenance, technical problems, software updates, hosting issues, security incidents, network outages or other operational circumstances.

We do not guarantee uninterrupted access to the website.

23. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

In particular, nothing in these Terms is intended to exclude or restrict mandatory consumer rights or other liabilities that cannot lawfully be excluded.

To the extent permitted by applicable law, liability for indirect or consequential losses will be determined in accordance with applicable law and the circumstances of the relevant transaction.

24. Events Outside Our Reasonable Control

Orders or services may be affected by circumstances outside our reasonable control, such as:

  • Severe weather;

  • Natural disasters;

  • Government restrictions;

  • Transportation disruptions;

  • Carrier interruptions;

  • Telecommunications failures; or

  • Other significant operational disruptions.

Where such circumstances affect an order, we will make reasonable efforts to address the situation.

Mandatory consumer rights remain unaffected.

25. Governing Law and Disputes

These Terms and purchases made from Remarkable outdoor ApS are governed by the laws of Denmark, subject to applicable conflict-of-law rules and mandatory consumer-protection requirements.

If you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protections applicable to you.

If a dispute arises, you may contact us so that we can attempt to resolve the matter.

Nothing in these Terms requires a consumer to waive access to a court or dispute-resolution mechanism available under applicable law.

26. Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, operations, technology or applicable legal requirements.

The current version will be published through our online store with an updated revision date.

Changes will not retroactively remove mandatory rights associated with purchases already completed.
